These Terms of Service ("Terms") govern your access to and use of the Domos Mirador website, booking platform, WhatsApp Business communications, Facebook and Instagram pages, AI concierge (Valeria), and any related services (collectively, the "Services"). By using any of the Services, you agree to be bound by these Terms.

1. Who we are

Observatorio Domos Bosque Tropical SRL ("Domos Mirador," "we," "us," or "our") is a Costa Rica company operating Domos Mirador Glamping and related hospitality services in Montes de Oro, Puntarenas, Costa Rica. 2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to make a booking. By using the Services you represent that you meet this requirement and that the information you provide is true, accurate, and complete.

3. Bookings, rates, and payment

  • Reservations are confirmed only after we receive payment of the applicable deposit and you receive a confirmation message from us (via email or WhatsApp).
  • Rates are quoted in USD or CRC and may include or exclude taxes and service fees as indicated at the time of booking.
  • Payment is processed by PCI-compliant providers (e.g., Stripe, PayPal). We do not store full payment card numbers.
  • Pricing, availability, and inclusions may change without notice; the terms in force at the moment of booking apply to that reservation.

4. Cancellations, modifications, and no-shows

Full payment is required at the time of booking. Cancellation, modification, and refund policies are stated at the time of booking and in your confirmation. Unless otherwise stated:

  • Cancellations more than 14 days before arrival: 50% refund.
  • Cancellations 13 days or less before arrival: non-refundable.
  • Exceptional cases: documented medical or family emergencies are evaluated individually.
  • Satisfaction guarantee: if on arrival you are not satisfied with the accommodation, you may receive a full refund provided you (a) notify reception within one hour of arrival and (b) have not used the accommodation (no overnight stay).
  • Force majeure (natural disasters, government restrictions) is handled case-by-case.
  • Cancellation requests: cancellations@domosmirador.com.

5. Check-in, conduct, and property rules

Standard check-in is 3:00 p.m. and check-out is 11:00 a.m. (local time). Government-issued identification may be required at arrival in accordance with Costa Rica's tourism and public-safety regulations. You agree to use the property responsibly, respect other guests, follow posted safety rules, and refrain from illegal activities, smoking in non-designated areas, candles or open flames inside the domes, or unauthorized parties. Quiet hours apply after 22:00. Pets are welcome with an additional fee. Domos Mirador is an adults-only glamping experience. We may terminate your stay without refund for material breach.

6. Liability and assumption of risk

Domos Mirador is located in a tropical natural environment. You acknowledge that outdoor activities and contact with wildlife, terrain, and weather involve inherent risks. To the maximum extent permitted by Costa Rica law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our aggregate liability is limited to the amount you paid for the affected reservation.

7. WhatsApp, Messenger, and AI concierge ("Valeria")

We operate an AI-assisted concierge (Valeria) that may respond to your messages on WhatsApp Business and Messenger. By messaging us on these channels you understand that:

  • Your messages may be processed by automated systems (including third-party AI providers such as Anthropic) to generate replies.
  • A human team member may review, edit, or override AI-generated responses.
  • Quotes, availability, and pricing communicated via these channels are non-binding until formally confirmed.
  • You may request a human agent at any time by replying "human" or contacting domosmirador@gmail.com.

8. Meta Platform (Facebook, Instagram, WhatsApp Business)

Our use of Meta APIs (Facebook Login for Business, WhatsApp Business Cloud API, Messenger Platform, Instagram Graph API, Meta Lead Ads, Meta Marketing API) is governed by these Terms together with the Meta Platform Terms, the WhatsApp Business Messaging Policy, and the WhatsApp Business Solution Terms. We use these integrations strictly for the operation of our own hospitality business, not as a service provider for third-party businesses.

9. Intellectual property

All content on the Services — including text, photography, video, the Valeria voice and persona, logos, and the Domos Mirador brand — is owned by Observatorio Domos Bosque Tropical SRL or its licensors and is protected by Costa Rica and international intellectual-property law. You may not reproduce, distribute, or create derivative works without our prior written permission, except for personal, non-commercial use of publicly shared content.

10. Privacy

Our processing of personal data is described in our Privacy Policy. Requests related to data access, correction, or deletion can be sent to privacy@domosmirador.com or via the procedure described in our Data Deletion Instructions.

11. Reviews, photos, and user content

If you submit reviews, photos, or other content related to your stay, you grant Domos Mirador a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Services and our marketing, with attribution where reasonable. You confirm that you have the rights necessary to grant this license.

12. Third-party services

The Services rely on third-party providers including Octorate (property management), Stripe and PayPal (payments), Meta (WhatsApp, Facebook, Instagram), Kommo (CRM), n8n (workflow automation), Anthropic (AI inference), and Cloudinary (media). We are not responsible for the policies, practices, or availability of these third parties.

13. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page indicates when the latest version was published. Material changes will be communicated through our website and, where appropriate, through email or WhatsApp.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Costa Rica. Any dispute arising from these Terms or the Services will be resolved by the competent courts of San José, Costa Rica, unless mandatory consumer-protection law in your jurisdiction provides otherwise.
